These Terms of Service ("Terms") govern your use of the website and services of Brimio LLC, doing business as Phoenix Rise Energy ("Phoenix Rise Energy," "we," "us," or "our"). By using our website, our savings estimate tool, or contacting us, you agree to these Terms. If you do not agree, please do not use the site.
1. Who can use our services
Our website and services are intended for adults (18 and older) who own a home in Arizona, or are buying one, and want to learn about home solar. You agree to give accurate information and to use the site only for lawful, personal purposes. You agree not to misuse the site, interfere with how it works, or use it to break any law.
2. Savings estimates are estimates, not a guarantee
Any savings figures, payback periods, system sizes, panel counts, prices, financing terms, tax-credit amounts, or roof and solar-potential results we show are estimates only. They are not a guarantee and not a binding quote. Some of these estimates are generated using mapping and solar data from third parties such as Google, and using the figures read from a bill you choose to upload, so they are only as accurate as that data.
Any savings figures rest on the assumptions shown alongside them, such as your stated bill, usage, and rate. Individual results vary from home to home. Your actual results depend on your home, roof, energy usage, utility and rate plan, rate changes over time, credit qualification, equipment, installation, available incentives and tax credits, and other factors, many of which change and are outside our control. Solar tax credits and incentives depend on your individual situation and current law, so please consult a qualified tax professional. Nothing on this site is a binding offer, a final price, or a promise of specific savings. Your exact number comes from a consultation and a detailed review of your specific home and bill.
3. Agreeing to be contacted
If you give us your phone number and check the box agreeing to be contacted, you agree a Phoenix Rise Energy advisor may call and text you about solar, including by automated or prerecorded means, as described in our Privacy Policy. Agreeing to this is not a condition of buying anything. Message and data rates may apply and message frequency varies. You can reply STOP to any text to opt out, reply HELP for help, and ask us to stop calling at any time. Please see our Privacy Policy for the full details on calls and texts.
4. Your three-day right to cancel an in-home sale
If you sign a contract to buy a solar system during a visit at your home, Arizona law gives you the right to cancel. You may cancel until midnight of the third business day after you sign. When you sign such a contract, you will receive a written Notice of Cancellation that explains how to cancel and gives you a form to use. If you cancel in time, you get your money back as the law provides. This three-day right applies to in-home sales of a solar system; it is separate from this website and from any estimate you get here.
5. Third-party services and data
Parts of our site rely on services from other companies, such as mapping and solar-potential data from Google and the tools we use to read an uploaded bill, host the site, send messages, and run analytics. We are not responsible for those companies' services or for the accuracy of data they provide. Our site may also link to other websites, such as your utility or a government page, that we do not control and are not responsible for. Our Privacy Policy explains which providers we use and what they receive.
6. Our content and marks
The website and its content, including text, graphics, logos, and the names "Phoenix Rise Energy" and "Brimio LLC," are owned by or licensed to us and are protected by intellectual-property laws. You may not copy, reproduce, or use our content or marks without our written permission.
7. Disclaimer of warranties
The website and its content are provided "as is" and "as available," without warranties of any kind, whether stated or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows.
8. Limitation of liability
To the fullest extent the law allows, Phoenix Rise Energy and Brimio LLC are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or expected savings, that arise from your use of the website or your reliance on any estimate or content on it.
9. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules.
